In-store & Online Competition Terms and Conditions

Any information relating to this Sales Promotion on how to enter this Sales Promotion forms part of the conditions of entry. These Terms and Conditions set forth the legally binding terms for your participation in this Sales Promotion. By registering to participate in this Sales Promotion you agree to be bound by these Terms and Conditions. Please read them carefully and if you do not agree to any of the terms set out below, please do not register to participate.

1. Definitions

“BurgerFuel” means Burger Fuel Limited.

“BurgerFuel Store” and “BurgerFuel Stores” means any and all stores located in New Zealand and operated by Burger Fuel Group Limited or its franchisees, and in accordance with the BurgerFuel system.

“Birthday Hook Up” means a free BurgerFuel side i.e. ‘Spud Fries’ (with Aioli), or Kumara Fries(with Aioli), or a Shake (flavour of Entrant’s choice), or ‘Choppers’ (with Sriracha or BBQ sauce and Aioli) awarded with any burger purchase during the Sales Promotion; only able to be used in conjunction with the recipient's next BurgerFuel purchase, (which must include a large burger), and can be redeemed in-store by stating the Entry Card voucher code at the till, or via online ordering by including all items, including free item, to cart and entering Entry Card voucher code at the checkout. Birthday Hook Up is subject to T&Cs and is valid until 9/11/25.

“Voucher Code” means the 6-digit code found on the Entry Card that entitles the recipient to a Birthday Hook Up.

“Entry Card” means the information card that will be given to every customer when they purchase any burger in-store or via online ordering from any BurgerFuel Store which explains how to enter this Sales Promotion and includes a Birthday Hook Up.

“Entry” means a general entry into the BurgerFuel Harley-Davidson® giveaway when a customer purchases a burger and enters into the Sales Promotion. Customer is entitled to one entry per order that includes a burger purchase.

“Bonus Entry” means an automatic VIB Club bonus entry into the BurgerFuel VIB Club giveaway when a customer purchases any gourmet burger during the Sales Promotion and is a VIB Club Member at the time of purchase. Member is entitled to one VIB Club Bonus Entry per order that includes a burger purchase.

“BurgerFuel Harley-Davidson® giveaway” means the main prize that will be given away to the winning Entrant (must be 18 or over) as part of this Sales Promotion, in accordance with clause 4 and all its sub-clauses. The prize includes:

• 2025 Harley-Davidson® Street Bob™ Softail valued at $27,250 with customisations valued at approximately $15,000. Customisations and features include:

- Milwaukee-Eight 117 V-Twin engine

- Custom-painted fuel tank with BurgerFuel purple flames

- Custom leather seat

- S&S muffler

- Forward controls

- Lower handlebars

- Tail tidy

- Sissy bar

- Bedroll and duffel bag

- Genuine Harley-Davidson®  Adversary pegs and grips

- Leather swingarm bag

• ‘A Year’s worth of Burgers’, which entitles the Prize Winner to a free burger each week for one year. Weekly free burgers are issued as a ‘Club Good’ via BurgerFuel’s loyalty programme, VIB Club and expire at the end of each week (free burgers do not accrue). Weekly free burger is subject to T&Cs. Prize Winner is required to sign up to BurgerFuel’s VIB Club to be eligible to redeem weekly free burgers.
• One Year’s subscription to Submachine magazine, which entitles the Prize Winner to four issues of Submachine magazine, issued on a quarterly basis and valued at $100.
• Harley-Davidson® $250 voucher - subject to T&Cs.

“BurgerFuel VIB Club giveaway” means the secondary prize that will be given away to the winning VIB Club Entrant(must be 18 or over) as part of this Sales Promotion, in accordance with clause4 and all its sub-clauses. The prize includes:

• Next Level Racing Simulator Cockpit valued at $4,000 RRP
• PlayStation®5 Console valued at $800RRP
• 43" BRAVIA 3 | 4K Ultra HD TV valued at $900 RRP
• Sony INZONE gaming headset valued at$300 RRP
• Gran Turismo 7 digital game valued at$100 RRP
• 52 free BurgerFuel burger vouchers for Prize Winner to use at any BurgerFuel. Each burger voucher entitles bearer to any large burger, including two modifications. Burger vouchers will be supplied in monthly allotments of 4-5 from the end of the sales period to 30/10/2026.  

“Entrant” means a person who participates in this Sales Promotion and can enter the draw to win the BurgerFuel Harley-Davidson® giveaway. Entrant must be 18 or over to be eligible to participate in this Sales Promotion.

“VIB Club Entrant” means a VIB Club member who is automatically in the draw to win the BurgerFuel VIB Club giveaway. VIB Club Entrant must be 18 or over to be eligible to win the BurgerFuel VIB Club giveaway.

“Valid Receipt” means an in-store till receipt or online order confirmation email proving the purchase of any gourmet burger within the campaign period.

“Prize Winners” refers to the winner of the BurgerFuel Harley-Davidson® giveaway and the winner of the BurgerFuel VIB Club giveaway, in this Sales Promotion.

“Promotional Period” means 10:00am Wednesday 1^st October to 11:59pm Sunday 2^ndNovember 2025.

“Sales Promotion” means this BurgerFuel Machines Promotion.

“Terms and Conditions” means these terms and conditions.

2. HOW TO ENTER & REDEEM Birthday Hook Up:

2.1 The following steps must be followed to enter into the prize draw and redeem the Birthday Hook Up found on Entry Card. An entry is only valid for the prize being drawn at the time of entry.

Step 1: The Entrant purchases any gourmet burger via online ordering or in-store from any BurgerFuel Store over the Sales Promotion period and receives an Entry Card.

Step 2: Entrant can enter the BurgerFuel Harley-Davidson® giveaway by scanning the QR code found on the Entry Card or by heading directly to the competition web page at www.burgerfuel.com/winamachine, entering their details and uploading their receipt as proof of purchase.

a) If the Entrant is already a VIB Club Member, they are automatically in the draw to win the BurgerFuel Harley-Davidson® giveaway and will also receive a VIB Club Member exclusive Bonus Entry and are automatically in the draw to win the BurgerFuel VIB Club giveaway. VIB Club Entrant will receive a confirmation email or push notification if they have enabled marketing communications in their VIB Club account.

b) If the Entrant is not a VIB Club Member, they will not receive a Bonus Entry but can sign up to VIB Club for their chance to enter when they next purchase a burger during the Sales Promotion.

Step 3: The Entrant can redeem their Birthday Hook Up by purchasing a large gourmet burger during the Sales Promotion via the voucher code found on their Entry Card:

a)   In-store: By stating the voucher code at the till

b)   Online: By selecting all products, including free item, and adding to cart, then entering voucher code at the checkout.

On redeeming their Hook Up, they will be eligible for another entry into the Sales Promotion as a large burger purchase is required for redemption. Entrant can follow steps 1 –3 again.

3. SALES PROMOTION CONDITIONS:

3.1 Entry into this Sales Promotion is deemed as acceptance of these Terms and Conditions and confirmation that the Entrant has the necessary authority and capacity to participate.

3.2 These Terms and Conditions may change from time to time. It is the responsibility of the Entrant to ensure they check these Terms and Conditions for any changes which will apply from the date that they are made available. Terms and Conditions can be found on this page at www.burgerfuel.com/winamachine.

3.3 This Sales Promotion will run 10:00am 1^st October to 11:59pm Sunday 2^nd November 2025. Entries received after this time will be ineligible for entry.

3.4 BurgerFuel, its employees and their immediate families, participating agents and their associated agencies are ineligible to enter. BurgerFuel reserves the right to verify the validity of entries and the eligibility of entrance of any of the Prize Winners.

3.5 To be eligible to win any of the prizes, the Entrant must be 18+ years of age, a New Zealand resident and be able to provide proof of residency (in a form acceptable to BurgerFuel).

3.6 Entrants are entitled to one entry per receipt or order that includes a burger purchase . If Entrant wants to order more than one burger, they are entitled to place more than one order to enter more than once.

3.7 When entering the BurgerFuel Harley-Davidson® giveaway via the Website competition page, Entrants may not enter the same receipt from the same transaction if more than one burger was bought. Multiple entries by one entrant must show different transaction times.

3.8 VIB Club Entrants are automatically in the draw to win the BurgerFuel VIB Club giveaway and can opt out of this prize draw by emailing info@burgerfuel.co.nz. VIB Club Entrants will receive a confirmation email or push notification if they have enabled marketing communications in their VIB Club account.

3.9 BurgerFuel reserves the right to request proof of a Prize Winner’s identity for the prize, in the form of a passport, or driver licence or photo ID and proof of address, in the form of a utility bill, (or such other form as BurgerFuel considers acceptable). In the event that the winner(s) cannot provide BurgerFuel with proof of identity reasonably acceptable to BurgerFuel, BurgerFuel may withdraw the prize and select another prize winner for any of the prizes.

3.10 Only complete and correct entries are eligible for entry. BurgerFuel reserves the right to refuse any entry that BurgerFuel, in its sole discretion, considers incomplete or incorrect.

3.11 BurgerFuel reserves the right to exclude any person from participating in the Sales Promotion on reasonable grounds (as determined in the sole discretion of BurgerFuel).

3.12 BurgerFuel reserves the right to refuse to award the BurgerFuel Machines Giveaway, to any Entrant who BurgerFuel decides, in its sole discretion, has violated the Terms and Conditions of the Sales Promotion, gained unfair advantage in  the Sales Promotion or won any of the prizes.

3.13  Any prizes unclaimed within 48 hours of BurgerFuel having made reasonable efforts to contact the winner using the contact details provided will be deemed forfeited and may be redistributed at the sole discretion of BurgerFuel.

3.14 BurgerFuel reserves the right, at its sole discretion, to vary, suspend or terminate the Sales Promotion at any time, and for any reason including (without limitation)if the Sales Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other cause beyond the control of BurgerFuel that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Sales Promotion. BurgerFuel reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Sales Promotion and/or prizes.

3.15 Prizes are non-refundable and cannot be transferred to any person or converted into cash. No prizes may be auctioned, raffled or sold by any means, in part or in full. For the avoidance of doubt, should any Guest Prize Winner be determined by BurgerFuel as having been selected by means of an auction, raffle, draw, sale or other sub competition or Sales Promotion, BurgerFuel reserves the right to disqualify the Guest and/or the Prize Winner.

3.16  BurgerFuel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. BurgerFuel assumes no responsibility for any injury or damage to Entrants or any other person's computer related to or resulting from participation in or downloading any materials in this Sales Promotion.

3.17 Neither BurgerFuel nor any other person or party associated with this Sales Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in this Sales Promotion or with any prizes offered including (without limitation) any activities undertaken in connection with any prizes offered.

3.18 BurgerFuel’s decision in relation to any of the prizes is final and no correspondence shall be entered into.

4. FURTHER CONDITIONS ASSOCIATED WITH WINNING THE ‘BURGERFUEL MACHINES GIVEAWAY’

4.1 At 10:00am on Tuesday 4^th November 2025 BurgerFuel will randomly draw a Prize Winner from all Entrants, including those who entered the BurgerFuel Harley-Davidson® giveaway during the BurgerFuel Machines Sales Promotion and VIB Club Members who were automatically entered into the BurgerFuel Harley-Davidson® giveaway on purchasing a burger during the BurgerFuel Machines Sales Promotion. The prize will be drawn at the offices of BurgerFuel at 66 Surrey Crescent, Grey Lynn, Auckland, New Zealand. Prize may be drawn offsite.

4.2 At 11:00am on Tuesday 4^th November 2025 BurgerFuel will randomly draw a Prize Winner from all VIB Club Entrants who were automatically entered into the BurgerFuel VIB Club giveaway on purchasing a burger during the BurgerFuel Machines Sales Promotion. The prize will be drawn at the offices of BurgerFuel at 66 Surrey Crescent, Grey Lynn, Auckland, New Zealand. Prize may be drawn offsite.

4.3 BurgerFuel shall endeavour to contact the Prize Winner of the BurgerFuel Harley-Davidson® giveaway by the phone number and email provided upon entry or the phone number and email address of the VIB Club account holder who purchased a burger duirng the BurgerFuel Sales Promotion. The Prize Winner of the BurgerFuel Harley-Davidson® giveaway will be contacted by Jay and Dunc from The Rock Drive show between 3:00pm – 7:00pm on Thursday 6th November 2025. And BurgerFuel shall endeavour to contact the Prize Winner of the BurgerFuel VIB Club giveaway by the phone number and email address of the VIB Club account holder who purchased a burger during the BurgerFuel Sales Promotion.  In the event that the Prize Winners for either prize cannot be contacted by BurgerFuel by 10:00am Thursday 6^th November 2025. BurgerFuel reserves the right to award this prize to the Entrant whose name is drawn second. It is the Entrant’s responsibility to ensure they are available to be contacted on the date specified as the Prize Draw date.

4.4 The Prize Winners must notify BurgerFuel of the following details within 48 hours of being contacted by BurgerFuel:

* Name (in full);

*Phone number;

*Address;

* Any special assistance requirements and any other information reasonably required by BurgerFuel for the purposes of arranging the prize.      

4.5   Prize Winners must be 18 years or over. Prize Winners must provide their full name, date of birth and driver licence before November 7^th2025 to a BurgerFuel correspondent.

4.6   The BurgerFuel Harley-Davidson® giveaway and the BurgerFuel VIB Club giveaway cannot be exchanged for monetary value.

4.7   Non-compliance with rules by the Prize Winners may result in forfeiture of the BurgerFuel Harley-Davidson® giveaway or the BurgerFuel VIB Club giveaway. BurgerFuel remains the final decision maker in all matters relating to both prizes. All potential hazards or related expenses remain the responsibility of the Prize Winners.

4.8   In relation to the ‘Harley-Davidson®’ prize winner. The Motorcycle must be delivered to the Event prize winner at a Dealer, and Recipient will bear any costs associated with the transport of the motorcycle to the Dealer or the prize winner travelling to their closest Dealer for the purposes of delivery.

On delivery of the Motorcycle to the Competition Prize Winner, the relevant Dealer will ensure that the Motorcycle is road registered and covered for CTP insurance for 12 months at no cost to Recipient or the prize winner, prior to the prize winner test riding and accepting the Motorcycle.

The Event prize winner must take delivery of the Motorcycle no later than 31 December 2025. However, in the event of a redraw of the major prize, then the prize winner must take delivery of the Motorcycle no later than 31 January 2026.

5. Personal Information and Privacy:

5.1  BurgerFuel respects privacy rights under The Privacy Act 2020 and will comply with the privacy principles in respect of the collection of Personal Information “Personal Information” from any and all Entrants.

5.2  BurgerFuel will sight the photo ID provided and proof of address and will collect and hold the following Personal Information from Entrants to this Sales Promotion:

- Entrant’s first and last name;

- Entrant’s age;

- Entrant’s email address;

- Entrant’s mobile and or home phone number;

-  Entrant’s address details;

-  Entrant’s most frequented BurgerFuel Store.

5.3 BurgerFuel will use the Entrant’s Personal Information to manage, monitor and develop the Sales Promotion and to contact the Entrant if they are a winner of any of the prizes or as otherwise agreed by the Entrant.

5.4  Personal Information provided by Entrants at the time of entry is presumed to be true, and active (in the case of text or email), through to, and beyond the date of the Sales Promotion’s completion.

5.5  The Entrant has a two-business-day period from the time of entry to request their Personal Information be changed or removed from BurgerFuel’s database. They can do so by contacting info@burgerfuel.co.nz. If no request is made during this time, it is deemed acceptance that the information can be used at BurgerFuel’s discretion and by any other company associated with this Sales Promotion.

5.6   BurgerFuel may store an Entrant’s Personal Information on computer systems operated by third parties and will take reasonable precautions against unauthorised access and disclosure by those third parties. BurgerFuel will not share an Entrant’s Personal Information with third parties except:

-  that BurgerFuel may publish an Entrant’s name in connection with the Competition if the Entrant is a Prize Winner;

- to the extent necessary for those third parties to provide services to BurgerFuel in connection with the Sales Promotion; and

- as otherwise expressly permitted under these Terms and Conditions.

5.7 By entering into the Sales Promotion, the Entrant authorises BurgerFuel to disclose their Personal Information to any third party, assisting in the conduct of the Sales Promotion including Prize suppliers, or for publicity purposes surrounding the Sales Promotion. Where any personal information is provided to a third party, the use and maintenance of an Entrant’s Personal Information by that third party is outside BurgerFuel’s control and BurgerFuel accepts no responsibility or liability for such third party use.

5.8 Except as described in these Terms and Conditions, BurgerFuel will not disclose or use an Entrant’s Personal Information without said Entrant’s permission, unless required or permitted by law.

5.9 From time to time, BurgerFuel may send the Entrant, and the Entrant hereby agrees to receive, emails and other material relating to BurgerFuel and our related companies or products. The Entrant may opt out of receiving those emails, other materials at any time by clicking the unsubscribe link at the bottom of any marketing emails or by emailing us at info@burgerfuel.co.nz to request their email address be removed from the database. following the opt-out instructions provided in the relevant communication.

5.10 By entering this competition, all Entrants hereby grant BurgerFuel the non-exclusive right to, tape, sound record and photograph all their activities in connection with the Sales Promotion and (if applicable) any Prizes. The Entrant agrees that BurgerFuel owns all intellectual property rights including (without limitation) copyright in any of the above-named sources of footage and in all material incorporating said footage. The Entrants agree no compensation will be offered for use of any of the above-named material.

6. Governing Law          

The Terms and Conditions of the BurgerFuel Kids Ink. Giveaway Sales Promotion will be governed by and construed in accordance with the laws of New Zealand and each eligible Entrant hereby submits to the exclusive jurisdiction of the Courts of New Zealand.
