In-store & Online Competition Terms and Conditions

Any information relating to this Sales Promotion on how to enter this Sales Promotion forms part of the conditions of entry. These Terms and Conditions set forth the legally binding terms for your participation in this Sales Promotion. By registering to participate in this Sales Promotion you agree to be bound by these Terms and Conditions. Please read them carefully and if you do not agree to any of the terms set out below, please do not register to participate.

1. Definitions

“BurgerFuel” means Burger Fuel Limited.

“BurgerFuel Store” and “BurgerFuel Stores” means any and all stores located in New Zealand and operated by Burger Fuel Group Limited or its franchisees, and in accordance with the BurgerFuel system.

“Summer Session” means the main prize that will be given away to the winning Entrant (must be 18 or over) as part of this Sales Promotion, in accordance with clause 4 and all its sub-clauses. The prize includes:

• An event package for Prize Winner to host their own party or event, valued at $20,000 which includes:

• Venue hire for a single night, decided by BurgerFuel and the prize winner to the value of $6000

• Photographer valued at $2000

• BurgerFuel (food) catering from the BurgerFuel Catering menu for up to 100 guests and to the value of $2000.

- If event is not in the vicinity of a BurgerFuel store, an alternative food option will be provided to the same value or based on guest numbers.

• A DJ selected by BurgerFuel, playing on Radio BurgerFuel DJ Decks for 3 hours, valued at $1,000

• Beverages supplied by Coca-Cola Euro pacific Partners, or a bar tab to the value of $5,000

• Decorations and miscellaneous theming items to the value of $2,000

• BurgerFuel & Coca-Cola merchandise for the Prize Winner to the value of $2,000

“Entrant” means a person who participates in this Sales Promotion. Entrant must be 18 years or older.

“Valid Receipt” means an in-store till receipt or online order confirmation email proving the purchase of any gourmet burger within the campaign period.

“Prize Winner” refers to the winner of the Summer Session giveaway, in this Sales Promotion. Prize winner will be of 18 years or older.

“Promotional Period” means 10:00am Wednesday 3rd December to 11:59pm Monday 2nd February 2026

“Sales Promotion” means this BurgerFuel Summer Session Promotion.

“Terms and Conditions” means these terms and conditions.

2. HOW TO ENTER:

2.1 The following steps must be followed to enter into the prize draw. An entry is only valid for the prize being drawn at the time of entry.

Step 1: The Entrant purchases any gourmet burger and any classic soda from any BurgerFuel Store over the Sales Promotion Period.

Step 2: Entrant enters competition by scanning the QR code displayed on point of sale, or directly via the competition web page at burgerfuel.com/summersession, by uploading an image of valid receipt as proof of purchase and entering all required information in the competition web page entry fields.

3. SALES PROMOTION CONDITIONS:

3.1 Entry into this Sales Promotion is deemed as acceptance of these Terms and Conditions and confirmation that the Entrant has the necessary authority and capacity to participate.

3.2 These Terms and Conditions may change from time to time. It is the responsibility of the Entrant to ensure they check these Terms and Conditions for any changes which will apply from the date that they are made available. 3.3 This Sales Promotion will run 10:00am 3rd December 2025 to 11:59pm Monday 2nd February 2026. Entries received after this time will be ineligible for entry.

3.4 BurgerFuel, its employees and their immediate families, participating agents and their associated agencies are ineligible to enter, win. BurgerFuel reserves the right to verify the validity of entries and the eligibility of Entrants of any of the Prize Winners.

3.5 To be eligible to win the BurgerFuel Summer Session event package prize the Entrant must be 18+ years of age, a New Zealand resident and be able to provide proof of residency (in a form acceptable to BurgerFuel).

3.6 Entrants are entitled to one entry per receipt or order that includes a burger and classic soda purchase. If Entrant wants to order more than one burger and classic soda, they are entitled to place more than one order to enter more than once.

3.7 Entrants may not enter the same receipt from the same transaction if more than one burger and classic soda was bought. Multiple entries by one entrant must show different transaction times.

3.8 BurgerFuel reserves the right to request proof of a Prize Winner’s identity for the prize, in the form of a passport, or driver’s licence or photo ID and proof of address, in the form of a utility bill, (or such other form as BurgerFuel considers acceptable). In the event that the winner cannot provide BurgerFuel with proof of identity reasonably acceptable to BurgerFuel, BurgerFuel may withdraw the prize and select another prize winner for any of the prizes.

3.9 Only complete and correct entries are eligible for entry. BurgerFuel reserves the right to refuse any entry that BurgerFuel, in its sole discretion, considers incomplete or incorrect.

3.10 BurgerFuel reserves the right to exclude any person from participating in the Sales Promotion on reasonable grounds (as determined in the sole discretion of BurgerFuel).

3.11 BurgerFuel reserves the right to refuse to award the BurgerFuel Summer Session Giveaway to any Entrant who BurgerFuel decides, in its sole discretion, has violated the Terms and Conditions of the Sales Promotion or gained unfair advantage in participating in the Sales Promotion.

3.12 Any prizes unclaimed within 48 hours of BurgerFuel having made reasonable efforts to contact the winner using the contact details provided will be deemed forfeited and may be redistributed at the sole discretion of BurgerFuel.

3.13 BurgerFuel reserves the right, at its sole discretion, to vary, suspend or terminate the Sales Promotion at any time, and for any reason including (without limitation) if the Sales Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of BurgerFuel that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Sales Promotion. BurgerFuel reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Sales Promotion and/or prizes.

3.14 Prizes are non-refundable and cannot be transferred to any person or converted into cash. No prizes may be auctioned, raffled or sold by any means, in part or in full. For the avoidance of doubt, should any Prize Winner be determined by BurgerFuel as having been selected by means of an auction, raffle, draw, sale or other sub competition or Sales Promotion, BurgerFuel reserves the right to disqualify the Prize Winner.

3.15 BurgerFuel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. BurgerFuel assumes no responsibility for any injury or damage to Entrants or any other person's computer related to or resulting from participation in or downloading any materials in this Sales Promotion.

3.16 Neither BurgerFuel nor any other person or party associated with this Sales Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in this Sales Promotion or with any prizes offered including (without limitation) any activities undertaken in connection with any prizes offered.

4. FURTHER CONDITIONS ASSOCIATED WITH WINNING THE ‘SUMMER SESSIONS GIVEAWAY’

4.1 At 10:00am on Wednesday 4th February 2026 BurgerFuel will randomly draw a Prize Winner from all Entrants who entered the ‘Summer Session’ Sales Promotion during this prizes’ allocated run time. The prize will be drawn at the offices of BurgerFuel at 66 Surrey Crescent, Grey Lynn, Auckland, New Zealand. Prize may be drawn offsite.

4.2 BurgerFuel shall endeavour to contact the Prize Winner by the email provided upon entry. In the event that the Prize Winner cannot be contacted by BurgerFuel by 10:00am Friday 6th February 2026. BurgerFuel reserves the right to award this prize to the Entrant whose name is drawn second. It is the Entrant’s responsibility to ensure they are available to be contacted on the date specified as the Prize Draw date.

4.3 The Prize Winner must notify BurgerFuel of the following details within 48 hours of being contacted by BurgerFuel:

* Name (in full);

* Phone number;

* Address;

* Any special assistance requirements and any other information reasonably required by BurgerFuel for the purposes of arranging the prize.

4.4 Winner must be 18 years or over. Winner must provide their full name, date of birth and   drivers licence before Friday 6th February to a BurgerFuel correspondent.

4.5 The Summer Session Giveaway cannot be exchanged for monetary value, the bearer will not be entitled to a refund for any unused portion of the event package.

4.6 BurgerFuel will make reasonable endeavours to supply the components of the prize up to the maximum stated value. Any underspend relating to the procurement or provision of prize components will not be payable, refundable, or otherwise transferable to the prize winner.

4.7 The Summer Session must take place before March 31st 2026.

4.8 Non-compliance with rules by the Prize Winner may result in forfeiture of the Summer Session. BurgerFuel remains the final decision maker in all matters relating to the Summer Session Prize. All potential hazards or related expenses remain the responsibility of the Prize Winner.

4.9 By accepting the prize, the winner acknowledges and agrees that they are solely responsible for organising and hosting the Summer Session, including ensuring the safety and well-being of all guests.

4.10 BurgerFuel reserves the right to substitute this prize in whole or in part with a substitute prize/prizes of equal or greater value.

4.11 The Prize Winner must execute a release & waiver before the date of the Summer Session, (whenever that may be), releasing BurgerFuel and its owners, employees, personnel, representatives, agents, directors, officers, successors and/or assigns from any and all claims for liability including but not limited to such liability arising from any acts or omissions resulting in injury or illness to body or property of participants while participants are participating in the prize.

4.12 BurgerFuel’s decision in relation to any of the prizes is final and no correspondence shall be entered into.

5. Personal Information and Privacy:

5.1 BurgerFuel respects privacy rights under The Privacy Act 2020 and will comply with the privacy principles in respect of the collection of Personal Information “Personal Information” from any and all Entrants.

5.2 BurgerFuel will site the photo ID provided and proof of address and will collect and hold the following Personal Information from Entrants to this Sales Promotion:

- Entrant’s first and last name;

- Entrant’s age;

- Entrant’s email address;

- Entrant’s mobile and or home phone number;

- Entrant’s address details;

- Entrant’s most frequented BurgerFuel Store.

5.3 BurgerFuel will use the Entrant’s Personal Information to manage, monitor and develop the Sales Promotion and to contact the Entrant if they are a winner of any of the prizes or as otherwise agreed by the Entrant.

5.4 Personal Information provided by Entrants at the time of entry is presumed to be true, and active (in the case of text or email), through to, and beyond the date of the Sales Promotion’s completion.

5.5 The Entrant has a two-business-day period from the time of entry to request their Personal Information be changed or removed from BurgerFuel’s database. They can do so by contacting info@burgerfuel.com. If no request is made during this time, it is deemed acceptance that the information can be used at BurgerFuel’s discretion and by any other company associated with this Sales Promotion.

5.6 BurgerFuel may store an Entrant’s Personal Information on computer systems operated by third parties and will take reasonable precautions against unauthorised access and disclosure by those third parties. BurgerFuel will not share an Entrant’s Personal Information with third parties except:  

- that BurgerFuel may publish an Entrant’s name in connection with the Competition if the Entrant is a Prize Winner;

- to the extent necessary for those third parties to provide services to BurgerFuel in connection with the Sales Promotion; and

- as otherwise expressly permitted under these Terms and Conditions.

5.7 By entering into the Sales Promotion, the Entrant authorises BurgerFuel to disclose their Personal Information to any third party, assisting in the conduct of the Sales Promotion including Prize suppliers, or for publicity purposes surrounding the Sales Promotion. Where any personal information is provided to a third party, the use and maintenance of an Entrant’s Personal Information by that third party is outside BurgerFuel’s control and BurgerFuel accepts no responsibility or liability for such third party use.

5.8 Except as described in these Terms and Conditions, BurgerFuel will not disclose or use an Entrant’s Personal Information without said Entrant’s permission, unless required or permitted by law.

5.9 From time to time, BurgerFuel may send the Entrant, and the Entrant hereby agrees to receive, emails and other material relating to BurgerFuel and our related companies or products. The Entrant may opt out of receiving those emails, other materials at any time by clicking the unsubscribe link at the bottom of any marketing emails or by emailing us at info@burgerfuel.com to request their email address be removed from the database. following the opt-out instructions provided in the relevant communication.

5.10 By entering this competition, all Entrants hereby grant BurgerFuel the non-exclusive right to, tape, sound record and photograph all their activities in connection with the Sales Promotion and (if applicable) any Prizes. The Entrant agrees that BurgerFuel owns all intellectual property rights including (without limitation) copyright in any of the above-named sources of footage and in all material incorporating said footage. The Entrants agree no compensation will be offered for use of any of the above-named material.

6. Governing Law          

The Terms and Conditions of the BurgerFuel Summer Session Sales Promotion will be governed by and construed in accordance with the laws of New Zealand and each eligible Entrant hereby submits to the exclusive jurisdiction of the Courts of New Zealand.
