In-store & Online Competition Terms and Conditions

Any information relating to this Sales Promotion on how to enter this Sales Promotion forms part of the conditions of entry. These Terms and Conditions set forth the legally binding terms for your participation in this Sales Promotion. By registering to participate in this Sales Promotion you agree to be bound by these Terms and Conditions. Please read them carefully and if you do not agree to any of the terms set out below, do not register to participate.

1. DEFINITIONS

“BurgerFuel” means Burger Fuel Limited.

“BurgerFuel Store” and “BurgerFuel Stores” means any and all stores located in New Zealand and operated by Burger Fuel Limited or its franchisees, and in accordance with the BurgerFuel system.

“BurgerFuel Creative, Sweet Escape Giveaway” means the main prize that will be given away to the Prize Winner (who must be 18 years of age or over) as part of this Sales Promotion, in accordance with clause 4 and all its sub-clauses. The total prize value is NZ$8,000. The prize includes:

• Return economy class flights for four to Melbourne, Australia

• Airport transfers

• Accommodation for four (two hotel rooms) for four nights in Melbourne, Australia

• A street art tour for four in Melbourne, Australia

• One limited edition collab print from FLOX

• One limited edition collab print from Haser

• One limited edition collab print from James Hunt

• A Year of Burgers (valued at $1,000). Entitles the Prize Winner to one free burger each week for one year, distributed via BurgerFuel’s loyalty programme, VIB Club. The Prize Winner must agree to the VIB Club Terms and Conditions on sign up to receive their weekly free burger. Each free burger expires weekly and the offer is subject to terms and conditions which will be displayed in the member’s Club Goods Dashboard.

“Entrant” means a person who participates in this Sales Promotion.

“Valid Receipt” means an in-store till receipt or online order confirmation email proving the purchase of any burger within the Promotional Period.

“Prize Winner” refers to the winner of the BurgerFuel Creative, Sweet Escape Giveaway in this Sales Promotion. The Prize Winner must be 18 years of age or over.

“Promotional Period” means 10:00am Monday 5th October to 11:59pm Monday 30th November 2026.

“Sales Promotion” means this BurgerFuel Creative, Sweet Escape Sales Promotion.

“Terms and Conditions” means these terms and conditions.

2. HOW TO ENTER

2.1 The following steps must be followed to enter into the prize draw. An entry is only valid for the prize being drawn at the time of entry.

Step 1: The Entrant purchases any burger from any BurgerFuel Store or online during the Promotional Period.

Step 2:

The Entrant can access the competition web page www.burgerfuel.com/nz/creativeescape directly or by scanning the QR code in-store at the point of sale, or on select promotional material.

Step 3:

The Entrant must fill in the entry form at www.burgerfuel.com/nz/creativeescape. They must enter their name, email address and mobile number, upload a Valid Receipt as proof of purchase, agree to the Terms and Conditions and submit the form to be eligible for entry.

3. SALES PROMOTION CONDITIONS

3.1 Entry into this Sales Promotion is deemed as acceptance of these Terms and Conditions and confirmation that the Entrant has the necessary authority and capacity to participate.

3.2 These Terms and Conditions may change from time to time. It is the responsibility of the Entrant to ensure they check these Terms and Conditions for any changes which will apply from the date that they are made available. These Terms and Conditions can be found at www.burgerfuel.com/nz/creativeescape.

3.3 This Sales Promotion will run from 10:00am Monday 5th October to 11:59pm Monday 30th November 2026. Entries received after this time will be ineligible.

3.4 BurgerFuel, its employees and their immediate families, participating agents and their associated agencies are ineligible to enter or win. BurgerFuel reserves the right to verify the validity of entries and the eligibility of Entrants and the Prize Winner.

3.5 To be eligible to enter and win the prize, the Entrant must be 18 years of age or over and a New Zealand resident and be able to provide proof of residency (in a form acceptable to BurgerFuel).

3.6 Entrants may enter as many times as they wish, provided each entry is supported by a separate Valid Receipt.

3.7 Each Valid Receipt may only be entered once, regardless of how many burgers were purchased in that transaction. Multiple entries by one Entrant must show different transaction times.

3.8 BurgerFuel reserves the right to request proof of a Prize Winner’s identity for the prize, in the form of a passport, driver’s licence or other photo ID, and proof of address, in the form of a utility bill (or such other form as BurgerFuel considers acceptable). In the event that the Prize Winner cannot provide BurgerFuel with proof of identity reasonably acceptable to BurgerFuel, BurgerFuel may withdraw the prize and select another Prize Winner.

3.9 Only complete and correct entries are eligible for entry. BurgerFuel reserves the right to refuse any entry that BurgerFuel, in its sole discretion, considers incomplete or incorrect.

3.10 BurgerFuel reserves the right to exclude any person from participating in the Sales Promotion on reasonable grounds (as determined in the sole discretion of BurgerFuel).

3.11 BurgerFuel reserves the right to refuse to award the BurgerFuel Creative, Sweet Escape Giveaway to any Entrant who BurgerFuel decides, in its sole discretion, has violated these Terms and Conditions, or gained an unfair advantage in participating in the Sales Promotion or in winning the prize.

3.12 If the prize is unclaimed within 48 hours of BurgerFuel having made reasonable efforts to contact the Prize Winner using the contact details provided, it will be deemed forfeited and may be redrawn at the sole discretion of BurgerFuel.

3.13 BurgerFuel reserves the right, at its sole discretion, to vary, suspend or terminate the Sales Promotion at any time, and for any reason including (without limitation) if the Sales Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other cause beyond the control of BurgerFuel that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Sales Promotion. BurgerFuel reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Sales Promotion and/or the prize.

3.14 The prize is non-refundable and cannot be transferred to any person or converted into cash. The prize may not be auctioned, raffled or sold by any means, in part or in full. For the avoidance of doubt, should any guest of the Prize Winner be determined by BurgerFuel as having been selected by means of an auction, raffle, draw, sale or other sub-competition or sales promotion, BurgerFuel reserves the right to disqualify the guest and/or the Prize Winner.

3.15 BurgerFuel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. BurgerFuel assumes no responsibility for any injury or damage to Entrants or any other person’s computer related to or resulting from participation in or downloading any materials in this Sales Promotion.

3.16 Neither BurgerFuel nor any other person or party associated with this Sales Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in this Sales Promotion or with the prize, including (without limitation) any activities undertaken in connection with the prize.

3.17 BurgerFuel’s decision in relation to the prize is final and no correspondence shall be entered into.

3.18 Nothing in these Terms and Conditions limits or excludes any rights the Prize Winner may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot be limited or excluded by law.

4. FURTHER CONDITIONS ASSOCIATED WITH WINNING THE ‘BURGERFUEL CREATIVE, SWEET ESCAPE GIVEAWAY’

4.1 At 11:00am on Tuesday 1st December 2026 BurgerFuel will randomly draw a Prize Winner from all Entrants who entered the Sales Promotion during the Promotional Period. The prize will be drawn at the offices of BurgerFuel at 66 Surrey Crescent, Grey Lynn, Auckland, New Zealand, or at another location at BurgerFuel’s discretion.

4.2 BurgerFuel shall endeavour to contact the Prize Winner by phone and email using the details provided upon entry. In the event that the Prize Winner cannot be contacted by BurgerFuel by 10:00am Thursday 3rd December 2026, BurgerFuel reserves the right to award the prize to the Entrant whose name is drawn second. It is the Entrant’s responsibility to ensure they are available to be contacted on the prize draw date specified in clause 4.1.

4.3 The Prize Winner must notify BurgerFuel of the following details within 48 hours of being contacted by BurgerFuel:

* Name (in full);

* Phone number;

* Address;

* Any special assistance requirements and any other information reasonably required by BurgerFuel for the purposes of arranging the prize.

4.4 The Prize Winner and all three guests must be 18 years of age or over. The Prize Winner must provide BurgerFuel with the full name (as shown on their passport), date of birth and passport details of themselves and all three guests by Monday 7th December 2026.

4.5 The BurgerFuel Creative, Sweet Escape Giveaway must be taken outside of school holiday and public holiday periods, and blackout dates may apply. Final travel dates will be agreed between the Prize Winner, BurgerFuel and House of Travel, and will not be dictated solely by one party.

4.6 The BurgerFuel Creative, Sweet Escape Giveaway cannot be exchanged for cash, and the Prize Winner will not be entitled to a refund for any unused portion of the trip.

4.7 The Prize Winner and all three guests must hold valid passports at the time of booking.

4.8 The Prize Winner and all three guests must organise their own travel insurance. Visas (if required) are the responsibility of the Prize Winner and guests.

4.9 Flights, accommodation and tours are non-refundable once confirmed.

4.10 Non-compliance with these Terms and Conditions by the Prize Winner or their guests may result in forfeiture of the BurgerFuel Creative, Sweet Escape Giveaway. BurgerFuel remains the final decision maker in all matters relating to the BurgerFuel Creative, Sweet Escape Giveaway. All potential hazards or related expenses remain the responsibility of the Prize Winner.

4.11 Flights are economy class and depart from, and return to, the major New Zealand international airport closest to the Prize Winner, as determined by BurgerFuel and House of Travel.

4.12 The travel component of the prize must be taken between 1 January 2027 and 31 December 2027, subject to clause 4.5. The Prize Winner and all three guests must travel together on the same itinerary. If travel is not taken within this period, the travel component will be forfeited and no compensation will be provided.

4.13 Accommodation consists of two standard hotel rooms for four nights at a hotel selected by BurgerFuel and House of Travel. Check-in and check-out times are subject to the hotel’s policies. Any security deposit, bond or incidental charges required by the hotel are the responsibility of the Prize Winner.

4.14 The following are not included in the prize and are at the Prize Winner’s and guests’ own cost: meals, drinks, spending money, transport within Melbourne (other than the airport transfers included in the prize), additional tours or activities, room service, phone and internet charges, excess baggage, and any other costs not expressly included in the prize.

4.15 All components of the prize are subject to the terms and conditions, availability and operating requirements of the relevant suppliers, including House of Travel. The street art tour and any other activity may be affected by weather or supplier availability. If any component of the prize is cancelled, delayed or cannot be used, no refund or compensation will be provided, except where BurgerFuel elects to provide a substitute under clause 4.16.

4.16 BurgerFuel reserves the right to substitute any component of the prize with a component of equal or greater value if it becomes unavailable for any reason.

4.17 Passports must be valid for the full duration of travel. New Zealand citizens are generally granted a visa on arrival in Australia; travellers who are not New Zealand citizens may require a visa or Electronic Travel Authority (ETA) before travelling. BurgerFuel and House of Travel are not responsible if any traveller is refused boarding or entry into Australia, and no compensation will be provided in that event.

4.18 The Prize Winner is responsible for their guests, and each guest must agree to and comply with these Terms and Conditions. A guest may be replaced by another person aged 18 years or over, provided the change is made at least three months before the travel date, or otherwise in accordance with House of Travel’s terms and conditions.

4.19 BurgerFuel, House of Travel and the prize suppliers are not responsible for any delay, cancellation or disruption to travel caused by events beyond their reasonable control, including (without limitation) airline delays or cancellations, strikes, natural disasters, extreme weather, pandemics or government health or travel restrictions. Any part of the prize lost as a result will not be refunded, replaced or compensated.

4.20 To the extent permitted by law, BurgerFuel, House of Travel and the prize suppliers are not liable for any injury, illness, loss, damage or theft suffered by the Prize Winner or their guests during travel or while using the prize. BurgerFuel reserves the right to cancel the remainder of the prize, without compensation, if the Prize Winner or any guest behaves in a manner that is unlawful, unsafe or likely to bring BurgerFuel into disrepute.

4.21 The Prize Winner and their guests agree to participate in reasonable publicity in connection with the Sales Promotion, including photographs, video and social media content from the trip, which BurgerFuel may use without compensation.

4.22 The Year of Burgers will start on the week following the day that the Prize Winner confirms they accept the prize.

4.23 The three limited edition collab prints will be sent by post to the address provided by the Prize Winner and are expected to be received within 10 days of the Prize Winner being contacted and confirming they accept the prize. BurgerFuel is not responsible for postal delays or for prints lost or damaged in transit.

5. PERSONAL INFORMATION AND PRIVACY

5.1 BurgerFuel respects privacy rights under the Privacy Act 2020 and will comply with the privacy principles in respect of the collection of personal information (“Personal Information”) from any and all Entrants.

5.2 BurgerFuel will sight the photo ID and proof of address provided by the Prize Winner, and will collect and hold the following Personal Information from Entrants to this Sales Promotion:

- Entrant’s first and last name;

- Entrant’s email address;

- Entrant’s mobile phone number.

5.3 BurgerFuel will use the Entrant’s Personal Information to manage, monitor and develop the Sales Promotion and to contact the Entrant if they are the Prize Winner, or as otherwise agreed by the Entrant.

5.4 Personal Information provided by Entrants at the time of entry is presumed to be true, and active (in the case of text or email), through to, and beyond the date of the Sales Promotion’s completion.

5.5 The Entrant can opt out at any time of the request to change or remove their Personal Information from BurgerFuel’s database. They can do so by contacting info@burgerfuel.com[JH1.1]. If no request is made, it is deemed acceptance that the information can be used at BurgerFuel’s discretion and by any other company associated with this Sales Promotion.

5.6 BurgerFuel may store an Entrant’s Personal Information on computer systems operated by third parties and will take reasonable precautions against unauthorised access and disclosure by those third parties. BurgerFuel will not share an Entrant’s Personal Information with third parties except:  

- to the extent necessary for those third parties to provide services to BurgerFuel in connection with the Sales Promotion; and

- as otherwise expressly permitted under these Terms and Conditions.

5.7 Where a Sales Promotion is conducted with a promotional or brand partner, personal information may be collected by, or shared between, BurgerFuel and the promotional or brand partner for the purposes of administering the Sales Promotion, awarding prizes and, where the Entrant has agreed, sending marketing communications. Each party will handle any personal information it receives in accordance with applicable privacy laws and its own privacy policy. Where BurgerFuel receives personal information indirectly from a promotional or brand partner, BurgerFuel will comply with any applicable notification obligations under the Privacy Act 2020.

5.8 Except as described in these Terms and Conditions, BurgerFuel will not disclose or use an Entrant’s Personal Information without said Entrant’s permission, unless required or permitted by law.

5.9 From time to time, BurgerFuel may send the Entrant, and the Entrant hereby agrees to receive, emails and other material relating to BurgerFuel and its related companies or products. The Entrant may opt out of receiving those emails or other materials at any time by clicking the unsubscribe link at the bottom of any marketing email, by following the opt-out instructions provided in the relevant communication, or by emailing info@burgerfuel.co.nz to request their email address be removed from the database.

5.10 By entering this Sales Promotion, all Entrants hereby grant BurgerFuel the non-exclusive right to film, tape, sound record and photograph all their activities in connection with the Sales Promotion and (if applicable) the prize. The Entrant agrees that BurgerFuel owns all intellectual property rights including (without limitation) copyright in any of the above-named sources of footage and in all material incorporating said footage. Entrants agree that no compensation will be offered for use of any of the above-named material.

5.11 By entering this sales promotion, you agree to receive marketing communications and accept our Terms and Conditions and Privacy Policy.

6. GOVERNING LAW

The Terms and Conditions of the BurgerFuel Creative, Sweet Escape Sales Promotion will be governed by and construed in accordance with the laws of New Zealand and each eligible Entrant hereby submits to the exclusive jurisdiction of the Courts of New Zealand.
