THE ‘BURGERFUEL JOHNNY HASH' SALES PROMOTION TERMS AND CONDITIONS

1. DEFINITIONS:

"BurgerFuel: means Burger Fuel Limited;

"BurgerFuel HQ" means 66 Surrey Crescent, Grey Lynn, Auckland, New Zealand;

"BurgerFuel Store(s)" means any and all stores located in New Zealand and operated by BurgerFuel or a BurgerFuel franchisee;

"The Johnny Hash Prize" means the main prize outlined in 5.1(c)

"Promotional Period" means 10:00am Monday 10th March through to Monday 5th May 2025 at 11.59pm;

"Sales Promotion" means this "THE BURGERFUEL JOHNNY HASH" sales promotion;

"Terms and Conditions" means these "THE BURGERFUEL JOHNNY HASH" campaign terms and conditions; 

"You" "Your" means any eligible person who participates in this Sales Promotion.

"Rockshop" means Webb Enterprises Limited

2. ACCEPTANCE OF TERMS

2.1         Entry into this Sales Promotion is deemed as acceptance of these Terms and Conditions.

2.2         These Terms and Conditions may change from time to time. It is your responsibility to ensure you check these Terms and Conditions for any changes which will apply from the date that they are made available. 3. ELIGIBILITY

3.1         This Sales Promotion will run from 10:00am Monday 10th March 2025 through to Monday 5th May 2025 at 11.59pm.

3.2         BurgerFuel and Rockshop, its employees and their immediate families, participating agents and their associated agencies are ineligible to enter.

3.3         To be eligible to enter this Sales Promotion and win any of the prizes, you must:

(a)         be a New Zealand resident and be able to provide proof of residency (in a form acceptable to BurgerFuel) upon request;

(b)         agree to these Terms and Conditions;

(c)         consent to BurgerFuel and Rockshop sending you marketing emails, with the option to opt out when you click the unsubscribe link at the bottom of any marketing emails or email [email protected] to request your email address be removed from the database;

(d)         consent to the use of any photography of winning entrant and participants for future promotional use, inclusive of the following BurgerFuel or Rockshop channels: advertising on digital or print media, social media, websites.

(e) be a BurgerFuel VIB Club Member.

4. ENTRY

4.1         You may enter the Sales Promotion as many times as you wish, every time you purchase a Johnny Hash Feed (Johnny Hash burger, Spud Fries and any classic soda) OR any large burger during the Promotional Period.

4.2         Only complete and correct entries are eligible for entry. BurgerFuel reserves the right to refuse any entry that BurgerFuel, in its sole discretion, considers incomplete or incorrect.

4.3         To enter this Sales Promotion, you must complete all of the following:

(a)         purchase a Johnny Hash Feed (Johnny Hash burger, Spud Fries and any classic soda) OR any large burger from any BurgerFuel Store during the Promotional Period.

(b)         be a VIB Club member. 

5. PRIZES 

5.1       THE JOHNNY HASH PRIZE:

$5000 WORTH OF MUSIC GEAR FROM ROCKSHOP AND A YEARS WORTH OF BURGERFUEL

(a)         Prize Pack entrants will be eligible to win this prize from 10:00am, Monday 10th March 2025

(b)         Prize Pack winners will be drawn at 11:00am, Tuesday 5th May 2025

(c)         The prize pack consists of the following: 

   (i)         $5,000 worth of product found only at any Rockshop in New Zealand, courtesy of BurgerFuel and Coca-Cola Europacific Partners (NZ) LTD and Rockshop

   (ii)         Product courtesy of Rockshop, product must be in stock and Prize must be redeemed within 1 month of prize draw

   (iii)        A years worth of BurgerFuel, which consists of 52 burger vouchers (one per week of the year). Each voucher entitles the bearer to one free gourmet burger. Terms and conditions and weekly expiry is detailed on vouchers.

GENERAL:

5.2         All prizes will be drawn at BurgerFuel HQ by BurgerFuel's New Zealand Brand & Marketing Manager.

5.3         BurgerFuel reserves the right to substitute any of the prizes in whole or in part with a substitute prize of equal or greater value.

5.4         BurgerFuel’s decisions in relation to the winners of any prize and any and all details in respect of any prize are final and no correspondence shall be entered into.

5.5         Prizes are non-refundable and cannot be transferred to any person. Prizes may not be auctioned, raffled or sold by any means, in part or in full.

WINNING

6.1         BurgerFuel shall endeavour to contact the winners of the Johnny Hash Prize by the contact details provided upon entry.

6.2         In the event that a winner cannot be contacted by BurgerFuel within 24 hours of the relevant prize being drawn, BurgerFuel reserves the right to award that winner's prize to the entrant whose name is drawn second. It is your responsibility to ensure you are available to be contacted in this regard.

6.3         BurgerFuel reserves the right to refuse to award a prize to any person who BurgerFuel decides, in its sole discretion, has violated the Terms and Conditions of the Sales Promotion, gained unfair advantage in participating in the Sales Promotion, or won a prize using fraudulent means.

7. GENERAL

7.1         BurgerFuel reserves the right, at its sole discretion, to vary, suspend, extend, or terminate the Sales Promotion at any time, and for any reason including (without limitation) if the Sales Promotion is not capable of running as planned including the country or regions moving to Alert Level 4, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of BurgerFuel that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Sales Promotion.

7.2         BurgerFuel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries. BurgerFuel assumes no responsibility for any injury or damage to entrants or any other person's computer related to or resulting from participation in or downloading any materials in this Sales Promotion.

7.3         Materials associated with this Sales Promotion may contain links to external sites. Those sites are not part of BurgerFuel and, unless otherwise indicated, are not under BurgerFuel's control. No link appearing in any materials associated with this Sales Promotion and no external sites that link to any BurgerFuel materials are endorsed by BurgerFuel and no responsibility is taken for material in them. You agree that by accessing any linked site you are doing so at your own risk and you agree to fully indemnify BurgerFuel against any liability arising out of your accessing any linked site.

7.4         Neither BurgerFuel nor any other person or party associated with this Sales Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with this Sales Promotion or with any prizes offered.

7.5         Neither BurgerFuel nor any other person or party associated with this Sales Promotion shall be liable for any damage incurred to the booked accommodation in connection with this Sales Promotion or with any prizes offered.

7.6         You agree to hold harmless and release BurgerFuel and its officers and employees for any responsibility or liability for any risk, loss or damage that may occur during or as a result of this Sales Promotion.

8.1         BurgerFuel respects privacy rights under the New Zealand Privacy Act 2020 and will comply with the privacy principles in respect of the collection of personal information from you.

9. GOVERNING LAW

9.1       The Terms and Conditions of this Sales Promotion are governed and construed in accordance with the laws of New Zealand and you hereby submit to the exclusive jurisdiction of the Courts of New Zealand.
